Labor law – audit of employee records

The firm performed an employee audit at a well-known food manufacturing company.

The purpose of the audit was to verify the regularity and legality of the employer’s personnel processes. The study analyzed individual employee documentation, including sample documents used by the employer, as well as inter-company labor regulations. The personnel files of dozens of employees, the employer’s pay and work regulations, and other documents governing the provision of work for the company were reviewed. The evaluation was based on how employee records were conducted, their quality and compliance with labor laws. The analysis of personnel policies also required an audit of the rules for the provision of services to the company by individuals on the basis of civil law contracts (work contracts, commission contracts).

The legal and personnel audit covered not only company records, but also the employer’s practices, procedures and customs regarding its relationship with the employee. A comprehensive analysis allowed the company to assess the degree of compliance with its obligations as an employer, particularly those related to enabling employees to exercise their due labor rights and to comply with working time standards. As a result of the audit, it was determined which of the employer’s past actions are in compliance with labor laws, and which should be changed or eliminated altogether. According to the law firm, such audits are worthwhile for any company with more than 20 employees.
