Development conditions – complaint to the WSA
On behalf of clients – real estate owners in Krakow, a complaint was prepared to the provincial administrative court against the decision of the local government appeals board upholding the mayor’s decision on development conditions for the construction of an underground parking lot.
Most of the objections relate to environmental law issues, but a separate legal issue is whether a zoning decision can be issued by a municipal authority that is also an investor (the subject of
applying for a GM decision). In the opinion of the firm’s lawyers, an unacceptable situation has arisen where an administrative body is ruling on its own case. The validity of the charges will be decided by the court.
