Action for the unenforceability of an enforceable title – invalidity of a notarial deed

The firm filed a lawsuit with the court to deprive the enforceability of the enforceable title – a notarial deed containing a contractual penalty for failure to submit a timely offer with a statement of submission to execution under Art. 777 par. section 1 point 5 of the Code of Civil Procedure.

Without going into details at this stage, it can be said that the notarial deed in question imposing an obligation to pay a contractual penalty of several hundred thousand dollars is most likely invalid.

Many hours of legal analysis led to the drafting of a comprehensive lawsuit, which will be handled by the District Court in Poznan. The court issued a protective order.
