Transmission easement – objections to the expert opinion

In one of the transmission cases pending before a court in Lublin, an expert opinion was served to determine the amount of compensation for the transmission easement requested by the law firm’s client.

The estimate is for an amount of approximately PLN 50,000, which is twice as much as the client’s request. Lawyers for the firm prepared written, extensive objections to the opinion, seeking to demonstrate its internal inconsistencies and the adoption of erroneous assumptions. Each transmission case is

a challenge for lawyers and real estate appraisers, mainly due to the fact that so far we have not lived to see a uniform practice of expert opinions, and the development of valuation standards is not facilitated by the shaky jurisprudence of the courts.
