Trade unions – cassation complaint

The law firm, on behalf of two company trade union organizations, filed a cassation appeal with the Supreme Court in a case involving the transfer of funds to the Company Social Benefits Fund.

The defendant hospital failed to fulfill its obligation to transfer these funds. The dispute centers primarily around the question of whether union representatives signed an agreement not to make deductions for the ZFŚS (Social Security Fund) for two years. The thing is that the agreement document was merely initialed, and therefore, in light of generally accepted rules of interpretation,

only prepared for further negotiation and possibly signature. The cassation complaint filed by the firm alleged, among other things. among other things argumentation regarding the inadmissibility of considering paraphrases on individual pages of a document as a signature to its contents.
