Special road law – cassation appeal

The law firm accepted an assignment to file a cassation appeal with the Supreme Administrative Court in a case involving a localization decision issued on the basis of the so-called “localisation decision” road speculation, the Act of April 10, 2003 on special rules for the preparation and implementation of investments in the field of public roads.

The client, represented by the law firm, is demanding respect for the property rights of the properties belonging to her, which are located along an expanded road of national importance. Previous administrative decisions and the judgment of the Provincial Administrative Court

in Warsaw gave priority to public purposes, which led to the loss of value of the client’s plots of land. The cassation appeal that is being prepared aims to overcome such a position of the administrative authorities.
