Spatial development – Bishop’s Square in Krakow

The law firm undertook the representation of the residents of Biskupi Square in Cracow in an administrative dispute over the development conditions for a project involving the construction of an underground parking lot.

An appeal to the Local Government Board of Appeals has been prepared. This is a retrial after a favorable ruling by the Regional Administrative Court in Krakow. The case involves a number of interesting issues in administrative procedure. In particular, our lawyers question the admissibility of issuing a WZ decision by the executive body of a municipality, when the same municipality is the investor.

Despite the objections formulated by the law firm, the decision was reissued by the authority that ruled on its own case.

The subject of the appeal is also a violation of a number of provisions of the Code of Administrative Procedure, the Law on Planning and Spatial Development and the Law on Providing Information on the Environment and its Protection, Public Participation in Environmental Protection and Environmental Impact Assessments.
