Return of works of art – favorable court ruling
Today the District Court of Poznań Stare Miasto announced a verdict in a case brought by our client against the National Museum in Poznań for the release of three paintings belonging to the family collection.
The court, in a non-final judgment, ordered the defendant to release the artworks. The settlement came after a trial that lasted more than a year and a half, in which the defendant disputed all the circumstances, including the provenance of the museum objects. The statute of limitations was also raised.
Attorney-at-law Przybecki presented a complex argument indicating the need for the court to apply a number of factual presumptions (Article 231 of the Code of Civil Procedure) and why the statute of limitations charge should not be accepted. The verdict is not final.
