Property law – the seizure of municipal lots

The law firm has obtained for the client a final decision on the acquisition of ownership of real estate by inheritance.

The proceedings before the Poznań court concerned a plot of land in the southern part of Poznań, whose tabular owners were the State Treasury and the City of Poznań, respectively, and which had been in the possession of the law firm’s client for more than forty years and was treated by him as part of his own land.

Listed in the Land and Mortgage Register as successive owners, the State Treasury and the City of Poznań made no claims to the plot for decades and never exercised any ownership rights. Only recent field inspections by city services revealed inconsistent entries

in the land and mortgage registers with the actual legal status, hence it was necessary for the law firm’s client to defend his ownership rights. This is yet another positive ruling in an action to declare the seizure of a property along the same street, obtained by the law firm.

In this area there are numerous problems related to property relations, resulting from the disorderly legal status of individual properties. It is not ruled out that further field inspections will trigger the need for additional right holders to defend their property rights.
