Land development – legal opinion
Attorney-at-law Tomasz Przybecki, at the request of a Warsaw joint-stock company, has prepared a legal opinion on the admissibility of issuing a decision on land development conditions for an investment involving the construction of an agricultural biogas plant.
One of the key issues was the interpretation of the premise of “continuation of the function of the development,” as referred to in Article 61 (1) (1)
of the Law of March 27, 2023 on spatial planning and development.
