Land development – compensation from the City of Poznań for changes in the local plan

At the request of a limited liability company, the law firm undertook representation in a dispute with the City of Poznań against the background of the adopted local development plan Łacina – B in Poznań.

The client owns attractive land in Rataje, which was intended to be used for hotel and service development. As a result of the adoption of the local plan, the designation of the disputed land was specified as “open greenery,” which in practice excludes any possibility of developing the plot. The situation is all the more difficult because green areas are not subject to expropriation by the

municipality, so as a result, the owner, after the adoption of an unfavorable local plan, is left with a property that he cannot use or sell. The law firm undertook the representation of the owner of a plot of land in a lawsuit for forced buyout of the property or payment of compensation. Such an opportunity is provided by the provisions of the Law on Planning and Development.
