Investment process – start of process by 1.6 million
Today in the District Court in Poznań, the first hearing was held on a claim by the general contractor against the investor – a client of the law firm – for payment of PLN 1.6 million as reimbursement of contractual penalties allegedly wrongly charged by the investor.
The firm’s lawyers have prepared an extensive response to the lawsuit and are representing the defendant investor at the hearings before the court. Earlier, courts of both instances had validly denied the plaintiff’s requests for injunctive relief.
The process will analyze issues related to contractual penalties and the essence of an unconditional and payable on first demand bank guarantee.
