Intellectual property – final verdict

Today, a final judgment was handed down in the Poznań Court of Appeals dismissing the plaintiff’s appeal and resulting in the dismissal of the lawsuit against the law firm’s client, an FMCG company.

Lawyers for the firm defended the client in a lawsuit over alleged copyright infringement of packaging designs and logos. After a trial that lasted more than 2 years, the courts of both instances dismissed the claims, agreeing that the plaintiff had failed to prove the prerequisites for the defendant’s liability, first and foremost

First of all, he did not demonstrate his authorship of the disputed branding elements. On the legal side, an interesting issue was the impact of the Constitutional Court’s June 23, 2015 SK 32/14 ruling on the pending proceedings.
