Construction law – defense of the designer in the compensation process
Another hearing was held before the District Court in Poznań in a case against the design company that carried out a set of construction and detailed designs for the city stadium in Poznań.
The claimant is seeking payment of approximately 8 million zloty for alleged damage related to the need for additional work at the stadium. According to the defendant, there was no misconduct on the part of the designers, and the possible damage is due to the improper management of the project and lack of experience in the implementation of facilities
large-scale construction on the part of other participants in the construction process. On the legal side, the statute of limitations and the question of the self-existence/non-self-existence of ex contractu claims remains an interesting issue.
