Compensation for the local plan – preparing a lawsuit
The law firm, after consulting with appraisers, prepared a lawsuit against one of the municipalities in the suburbs of Poznań for compensation for the decrease in the value of the property as a result of the enactment of the local zoning plan (Article 36(1) of the Law on Planning and Spatial Development).
The provisions of the new local plan prevent customers from using their properties as before. Since negotiations with the municipality
did not lead to a settlement, it became necessary to go to court.
