Compensation for the local plan – a win at first instance
We won a case before the District Court in Poznań on behalf of our client against one of the municipalities in the suburbs of Poznań for compensation for a decrease in the value of real estate as a result of the enactment of an unfavorable local zoning plan.
The case is complicated by the fact that the compensation relates to one of the parcels of land covered by the larger land registry, and moreover, between the date the plan was adopted and the date of the claim, a number of legal actions took place regarding the property
in question, including the division of the estate. The District Court agreed with the argument in the lawsuit that compensation can be claimed only as to one of the plots of land included in the land register. The verdict is not final.
