Cancellation of the local plan – judgment of the WSA
The Provincial Administrative Court in Poznań upheld the law firm’s complaint against the local zoning plan adopted in 2001 by the City of Zlotow.
The firm represented a landowner in a case involving unfavorable provisions of a local plan. A local development plan enacted in 2001 formally earmarked the client’s property for residential and hotel purposes, but at the same time, in practice, prevented development of the site due to the specific provisions of the plan.
At the same time, the adoption of the plan was not preceded by the adoption of a study of the municipality’s land use conditions and directions. The court found in favor of the law firm’s arguments and declared the contested local plan invalid in its entirety.
