Land development – compensation for the local plan
On behalf of the owner of a property located in Czerwonak Municipality, the law firm will conduct proceedings against the municipality for payment of compensation for the decrease in the value of the property caused by the adoption of a local zoning plan, in which part of the property was designated for a public road, which evidently affected the value of the plot. The legal basis for the demands is Article 36 (1) Law on Planning and Development. The statute of limitations for asserted claims, which is not explicitly regulated in the law, may prove to be an interesting issue.
