Implementation of the preliminary agreement – court settlement

The case was complicated because the buyer had entered into a preliminary agreement with the defendant’s legal predecessor. However, the seller died shortly after the conclusion of this agreement.

The law firm conducted proceedings to declare the deceased’s inheritance and filed a lawsuit against her heir for an obligation to make a declaration of intent to execute the preliminary agreement.

The defendant, as the heir of the owner of the property, as a result of settlement talks, entered into a promised contract with the plaintiff for the sale of this apartment, and, moreover, the parties agreed on the settlement of legal costs.
