Sequestration – litigation costs

The District Court in Poznań heard the law firm’s complaint against the district court’s decision on court costs in a case of seizure.

Although the district court found that the property had been acquired through seizure, as requested by the law firm, it did not award the client reimbursement of legal costs, despite the fact that the tabular owner consistently denied the prerequisites for seizure. After reviewing the law firm’s complaint, the District Court amended the

appealed order and awarded our client reimbursement of legal costs, holding that in this type of case, despite its non-trial nature, the interests of the parties are clearly at odds, and therefore the costs of the proceedings should be charged in full to the losing party.
