Restoration of possession – favorable judgment
As a result of a lawsuit prepared by the law firm, the court ordered the defendant to restore possession taken from the law firm’s client arbitrarily by replacing the locks and preventing access to the property.
The verdict is not final, yet immediately enforceable. This ruling is a warning to all property owners who, without due process of law, arbitrarily try to get rid of their own property forfeiters legal title to use it. Regardless of the evaluation of the
current legislation, it should be remembered that the Polish legal system protects not only ownership, but also the undisturbed possession of things.
