PLN 2.3 million in compensation awarded for unlawful nationalization of a palace-and-park complex
In December 2023, we informed about the filing of a lawsuit against the State Treasury seeking payment of over PLN 2.3 million in compensation for unlawful nationalization – the Law Firm, acting on behalf of the heirs of the pre-war owners of the palace and park complex, filed a lawsuit against the State Treasury for compensation for the loss of ownership rights to the property.
The State Treasury unlawfully nationalized the real estate that had formerly belonged to the clients’ predecessors in title, which was confirmed by the decision obtained earlier through the efforts of the Law Firm stating that this palace and park complex did not fall under the PKWN decree on the implementation of the agricultural reform. Had the State Treasury not carried out this unlawful nationalization and its subsequent transfer to a local government unit, the clients would have had the possibility of recovering the palace in kind. However, the return of the property in kind became impossible, and it was necessary to seek monetary compensation.

Today, the District Court in Bydgoszcz granted the claim in its entirety, fully agreeing with the position presented by the Law Firm. The verdict is not final.
