Nationalization of enterprises – favorable expert opinion

A lawsuit by the heirs of the pre-war owners of a business illegally nationalized in the 1950s is pending before a Warsaw court. The firm is representing the plaintiffs in a dispute with the Minister of Economy over compensation.

At today’s hearing, the court served the parties with the opinion of a business valuation expert. The amount adopted by the expert is in line with the customers’ expectations expressed in the lawsuit. In these types of proceedings, the person of the expert is of colossal importance for a fair determination of compensation, especially when there is no trace left of the nationalized enterprise.

A proper valuation should, on the one hand, refer to hard components like real estate, inventory, fixed assets, and on the other hand, take into account the dynamics of development, goodwill and other soft components of the company. Conducting such analyses for more than 70 years back is undoubtedly an ambitious task that requires specialized knowledge.
