Housing communities – favorable verdict of the Court of Appeals in Poznań
Today a favorable verdict was handed down by the SA in Poznan, legally ending the dispute between the owners of the units, represented by the law firm, and the housing community over the revocation of a number of resolutions.
The Court of Appeals dismissed the appeal of the defendant housing community and affirmed the plaintiffs’ position that the community’s resolution, which sets the advance payment for the renovation fund disproportionately to the shares of individual units in the common property, is illegal.
Therefore, the community may not by vote set different burdens for individual unit owners than those resulting from their shares in the common property.
