Expropriations – return of road property
Attorney-at-law Tomasz Przybecki has filed a complaint with the administrative court against the decision of the Wielkopolska voivode refusing to return the expropriated property.
The dispute relates to the status of the land plot covered by the application, which according to the authorities of both instances has a road character. According to the law firm, the property in question cannot be considered a public road under the provisions of the Public Roads Law and its implementing regulations.
In addition, the widespread view in the case law that the designation of property for a public road is a circumstance that excludes the possibility of returning the property under the provisions of the Real Estate Management Law was challenged.
