Correction of the order – change of shares in the common property?

Nearly 10 years after the decision on the abolition of joint ownership of a Poznan tenement house became final, the court received an application from a participant in the proceedings to correct the decision by changing the size of the shares of each owner in the joint property.

Interestingly enough, the order in question was subject to an appellate review, and a cassation appeal to the Supreme Court followed. The law firm has filed an extensive letter outlining the legal arguments why it is not possible to

by way of rectification make interference with the shares of owners of individual units. The District Court, in a closed session, dismissed the request for rectification. The decision is not final.
