Compensation for the local plan

On behalf of the property owners, the law firm has begun efforts to obtain compensation from the City of Poznań.

The property, after the introduction of the new local zoning plan, lost its designation for residential and commercial development, as provided for in the 1994 general local zoning plan of the city of Poznań, and thus significantly lost its value. In the end – regardless of the provisions of the introduced local plan – the property was expropriated on the basis of the so-called “local plan”. road specs act, and the owner was paid compensation as if it were a plot of land that had been rendered unbuildable.

After the appraiser prepared the appraisal report, the law firm applied for payment of the compensation due under Art. 36 para. 1 of the Law of March 27, 2003. If the city decides not to voluntarily pay the compensation, it will be necessary to file a lawsuit in court for the City of Poznań to pay compensation for the actual damage suffered in connection with the enactment of the local plan.
