Compensation for road plots – Real Estate Management Law
In one of the Wielkopolska municipalities, a local zoning plan was passed, in which a sizable portion of the land was allocated for public roads.
The law firm was approached by a group of owners who, after the plan was passed, led themselves to the geodetic division and consequent physical separation of the road plots. According to Article 98 of the Real Estate Law, such a division of real estate results in the transfer by operation of law of road parcels to the municipality with compensation.
The firm’s lawyers will be tasked with obtaining compensation in the highest possible amount through negotiations with the municipality, and if these fail, through administrative proceedings.
