Compensation for lack of social housing – another completed case

The law firm once again led a case against the City of Poznań for compensation for failure to provide social housing to persons subject to an eviction judgment.

In the proceedings, the law firm represented the owner of the premises, in which two live without any legal title.
Following proceedings in 2014 against the tenants to vacate, vacate and surrender the apartment, the plaintiff obtained a final eviction judgment. At the same time, the court ruled that the tenants were entitled to social housing.

Despite the fact that the obligation to provide social housing to evicted persons was established by a final court judgment, the obliged municipality failed to provide it, citing a long waiting list. Accordingly, the law firm

based on art. 18 para. 5 of the Law of June 21, 2001 on the protection of tenants’ rights, the housing stock of the municipality and the amendment of the Civil Code has drawn up a lawsuit against the City for compensation for failure to provide social housing.

After taking evidence and proving the validity of the plaintiff’s claims, the parties reached a settlement under which the client received fair compensation and partial reimbursement of litigation costs. The case in question is another case handled by the law firm, in which the property owner obtained compensation from the municipality.
